1. Definitions

• “App”: Refers to the PicaFlic mobile application operated by OMOM LTD.
• “User” / “You”: Any individual accessing or using the App.
• “Child Account”: An account created and managed by a parent or legal guardian for a user under 18.
• “Parent / Guardian”: A person with legal responsibility for a child under UK law.
• “Content”: Any text, images, reviews, comments, messages, or other material submitted or generated by users.
• “Premium Features”: Paid features available through Apple, Google Play, or other approved billing providers, managed by RevenueCat.
• “Personalised Advertising”: Advertising tailored using user data, subject to age-based restrictions.
• “Personalised Content”: Recommendations, suggestions, or search enhancements based on user activity or preferences.
• “Third-Party Services”: External services integrated into the App, including TMDB, Firebase, Google AdMob, RevenueCat, Expo, and App Attest.

2. Introduction

These Terms govern your use of the PicaFlic App. By creating an account or using the App, you agree to these Terms. If you do not agree, you must stop using the App.

PicaFlic is designed to help friends organise movie and series nights, discover entertainment, plan events, and share viewing activity. PicaFlic does not provide streaming services. Trailers, clips, and imagery may be shown only where permitted by third-party providers such as TMDB.

You must not use PicaFlic for any illegal or criminal activity under UK law.

PicaFlic may use your information to improve features, personalise your experience, enhance app performance, and support business-related services. Additional details are provided in the Privacy Policy and Business Terms.

The App includes public reviews and comments. These features are not intended to function as social media. Self-promotion, incentivisation, or misuse of review features is strictly prohibited.

3. Eligibility & Age Requirements

Minimum Age: You must be at least 13 years old to use PicaFlic.

Ages 13–15

• Parental consent required for account creation
• Cannot enable personalised advertising
• Cannot purchase subscriptions without parental consent
• High-privacy defaults apply

Ages 16–17

• May create an account without parental consent
• May enable personalised advertising only with explicit opt-in
• High-privacy defaults apply

Ages 18+

• Standard personalised advertising enabled by default (with opt-out)
• Full access to personalised content features

Personalised Content: All users may opt out of personalised content (movie suggestions, friend suggestions, etc.) at any time.

4. User Accounts

Accounts are created using Firebase Authentication. You must provide accurate information and keep your login secure. App Attest may verify device integrity.

Account Ownership

You may only create:

• An account for yourself using your own personal information, or
• A Child Account for a minor under your legal care

Using an account that does not belong to you is prohibited.

Child Accounts

Parents or legal guardians may create and manage Child Accounts. Child Accounts may have restricted access to:

• Personalised advertising
• Personalised recommendations
• Social features
• Subscription purchases

OMOM LTD may introduce additional child-specific controls in the future.

Account Misuse

Misuse of account creation, login systems, or age-range APIs is prohibited. If you encounter an error or bug, you agree to report it to omomgeneralenquiries@omom.uk.

Account Deletion

• Users may request account deletion
• A 28-day grace period applies
• After deletion, user-generated content may be retained for 90 days for safety, moderation, or legal reasons
• OMOM LTD may retain data longer if part of an investigation

5. Social Features

The App includes:

• Messaging
• Friends lists
• Friend requests
• Suggested friends (mutual connections only)
• Movie picks
• Group activity
• Reviews and comments

You must not post harmful, illegal, abusive, misleading, or unsafe content.

All social features must be used in accordance with:

• UK GDPR
• ICO Children’s Code
• Online Safety Act 2026
• Apple and Google Play policies

OMOM LTD may moderate, remove, restrict, or suspend accounts at its discretion.

6. TMDB API Usage

The App displays data from TMDB. TMDB does not endorse PicaFlic.

You may not:

• Store TMDB images offline
• Reuse TMDB data commercially
• Imply TMDB affiliation

TMDB Terms apply and can be found at the official TMDB website.

7. Events & External Services

Cinema listings, events, or activities may be provided by external businesses. OMOM LTD is not responsible for:

• The accuracy of external listings
• The outcome of any event
• Actions taken outside the App

Users may provide information to support event features. This data is processed under the Business Terms and Privacy Policy.

8. Location-Based Features

The App may request location access to show nearby cinemas or events. You may decline at any time.

Location accuracy is not guaranteed.

Precise location is only collected with permission and processed according to UK GDPR. Location may be used to personalise content where permitted by age rules.

9. Subscriptions (RevenueCat)

Premium features may be purchased through:

• Apple App Store
• Google Play Store
• Other approved billing providers

RevenueCat manages entitlements.

Subscription Rules

• Subscriptions auto-renew unless cancelled
• Refunds are handled by Apple/Google
• Cancelling removes premium access at the end of the billing period
• Pricing may change with notice
• Refund timeframes depend on the platform provider
• Website purchases follow separate terms

Grace Period: Pro and Family plans include a 16-day grace period before automatic removal of services.

Plan Features

Pro Plan

• No ads
• View friends’ watched movies (subject to their privacy settings)
• Unlimited watchlists
• Additional streaming service filters
• Share with one friend (limited features)

Family Plan

• All Pro features
• 3 child slots (under-18 content only)
• Parental controls

Shared access features may be revoked at any time by the account owner or OMOM LTD.

10. Intellectual Property

OMOM LTD owns all App content except TMDB data and user-generated content.

You grant OMOM LTD a licence to display your content within the App.

Reverse engineering or copying the App is prohibited.

11. Disclaimers & Liability

The App is provided “as is”. We do not guarantee uninterrupted service or accuracy of third-party data.

To the fullest extent permitted by UK law, OMOM LTD is not liable for indirect or consequential losses.

12. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.

13. Changes to These Terms

OMOM LTD may update these Terms occasionally to reflect changes in services, legal requirements, or business operations.

When changes are material, we will provide reasonable notice, for example:

• In-app notifications
• Email
• Updated Terms displayed within the App

The updated Terms take effect on the date stated in the notice.

By continuing to use PicaFlic after the updated Terms take effect, you agree to be bound by the revised Terms.

If you do not agree, you must stop using the App and request account deletion.
